Terms and Conditions
Before using The Wash Laundry Services, carefully read the terms and conditions (‘T&Cs’) set out below.
These T&Cs apply to our website www.thewashlaundry.com.au and all our services booked online or through direct contact with The Wash Laundry Services.
The Wash Laundry Service provides professional pick-up and delivery laundry services to our customers and offers quality and convenience at an affordable price. Our services are subject to the terms and conditions below and applies to any order that The Wash Laundry Service accepts from you. Your use of The Wash Laundry services indicates your agreement to be bound by the terms and conditions contained herein. The terms and conditions are said to have been understood and explicitly accepted upon receival of the terms and conditions form through email or mail and booking of service when account is set up without using our online service portal, as well as upon booking services online.
Please read the following provisions carefully and let us know if you have any questions. During the course of business we may need to modify our terms. We encourage all our customers to review the T&C’s for updates. T&C’s may be changed at any time without prior notice.
Pick-up/Delivery
The Wash Laundry Service has your permissions to enter your property boundary line to pick up and deliver your laundry which includes but not limited to opening gates, entering a backyard or commercial premises when this has been advised as the pickup/drop off location. The Wash Laundry Service has your permissions to leave your laundry at the same address as it was picked up, whether you are home or not. However, you may arrange a face-to-face delivery which requires someone to physically receive the items. If you arrange a face-to-face delivery and you are do not advise that you will not be at the property a $15.00 missed delivery fee will be invoiced. This is payable before laundry is sent out for redelivery.
All services will be provided by The Wash Laundry Service and pick up/delivery will occur on a predetermined day and frequency. This arrangement may be changed by either The Wash Laundry Services or the customer by notifying The Wash Laundry Services by direct phone contact or email or through online appointment portal. Should you require a one-off change you will need to give 48 hour notice.
Laundry will be left outside your property (at a predetermined spot) at your own risk. Items left for pick up are not our responsibility until we collect them. This applies to delivery of laundry; once The Wash Laundry Services has delivered the items, they are no longer under our care.
The Wash Laundry Service is not responsible for or liable to pay for any loss, damage or theft of items left unattended by the customer for pick-up or deliver.
Suitability for laundry
By using any of our wash, dry, fold services you agree that all laundry items are suitable to be machine washed and tumble dried on our standard cycle. The Wash Laundry Services will not be held responsible for any damages to laundry pieces due to unsuitability for this type of laundry service.
Items such as but not limited to leather, suede and household items are sent at the customer’s own risk. We ask that you inform us of any unusual items to be laundered. We reserve the right to send the items back that we deem unsuitable for laundering.
We will not accept biohazardous items including but not limited to blood, urine, chemical spills, items used for cleaning of oil and flammable materials. Please do not send these without first contacting our main office directly on 0423 354 005 or support@thewashlaundry.com.au
Damaged laundry
The Wash Laundry Services will do everything possible to prevent damaging your laundry, however there are limitations to what we can do. Help us help you! We will not be held responsible for the following:
We kindly request that you thoroughly check all of your laundry and pockets before we launder your clothes. We endeavour to check that your laundry and pockets are empty, however it is not feasible that we will catch it all and will not be held responsible for any damaged or lost items in this regard (eg: lipstick, pen, chewing gum, jewellery). Should we find such items, we will endeavour to return these items promptly.
Please ensure you check the wash instructions before engaging our services. If an item is “dry-clean only” or unsuitable for our services, do not include it in the laundry you provide us.
We exercise the utmost care and streamline processes to ensure the safety of each item we pick-up and deliver to avoid loss or damage. However, if an instance where items get misplaced, lost or damaged occurs, it is the customers responsibility to report any loss or damage to clothes within 48 hours of pick-up/delivery. Failure to do so will release The Wash Laundry Services of all liability.
Where The Wash Laundry Services accepts liability of The Wash Laundry Services with respect to any lost item, liability shall not exceed $50 per garment regardless of brand or condition excluding leather, suede and household items which are always at customers’ own risk. Total loss liability per order shall not exceed $250 per order. This is permitted at the discretion of The Wash Laundry Services and dependant on circumstances of the order, including but not limited to: proof of item having been sent, video footage evidence from The Wash Laundry Services.
Wear and Tear on Laundry
The greatest care with all your items, however due to the nature of clothing and its natural incurrence of wear and tear by the use, The Wash Laundry Services will not be held responsible for any wear and tear, including fading, abrasions, holes, fatiguing or loss of buttons. Should we deem any item or items unsuitable we reserve the right to refuse those said items.
Diligence is taken to separate clothing that is sent for laundering into “like” loads (ie, separate loads for towels, darks etc) however we cannot be held accountable for the bleeding of colours or changes to the size and fit of your items. All items are tumble dried on med-high temperatures dependant on type of material. It is your responsibility to separate any delicate items that need to be treated separately (ie, hang dried or dried on low) and inform of this so that we may take the appropriate action when laundering. Delicate items treated separately will incur an additional charge.
By using any of The Wash Laundry Services you agree that all laundry items are suitable to be machine washed and tumble. Should items need special attention i.e stain removal, it is your responsibility to advise us at time of booking. If you have any allergies to washing detergents and fabric softeners, this too needs to be bought to the attention of The Wash Laundry Services at time of booking. The Wash Laundry Services will not be held responsible for any damages to laundry pieces due to unsuitability for this type of laundry service.
Cancellation of Service
You can cancel or reschedule your order any time up to 24 hours before your allotted window of pick up without any charges. If you cancel within 24 hours of pick-up, you will received an administration service charge of $10.00. We have a minimum call-out charge of $35.00, which will be invoiced or deducted from your pre-payment, regardless of if we pick up laundry or not. Please contact us ahead of time if you need to reschedule so that you do not incur a fee.
It is up to the customer to provide a written request of refund of payment to accounts@thewashlaundry.com.au This MUST be requested within 7 business days of the cancelled appointment time to ensure you receive payment. After this period, the Wash Laundry Services is not obligated to return the prepayment for services.
Invoicing
Payments
We require a credit card on file through our secure online processing system upon booking. We process this payment before returning your items. Please make sure to have adequate funds available.
Alternative payments can be made at any time by way of invoice, using direct deposit or Stripe processing system. If a customer does not pay by the date stated on the invoice, then they may incur a $5 per week penalty fee, unless an alternative payment period or payment plan has been priorly negotiated. This fee is to cover the cost of the additional administration required to follow up on the late payment. If you cannot pay within this time, please contact us to avoid any unnecessary late fee.
If invoices are unpaid for [30] days, The Wash Laundry Services has the right to engage debt collection services for the collection of unpaid and undisputed debt, and the right to commence legal proceedings for any outstanding amounts owed to us. The principal acknowledges and agrees that it is liable for and will pay all costs including debt collection, commission, solicitor’s fees and any out-of-pocket expense and that The Wash Laundry Services may place a default against the principal with a credit reporting agency. The customer will indemnify us for the full amount of our legal and debt recovery costs.
Our Liability
We and Our Service Providers are in full compliance with the Australian regulations governing laundry and dry cleaning services (AS/NZ 4146:2000).
Except as required under the Competition and Consumer Act 2010 (Cth) (as amended from time to time) or any other relevant legislation, We make no warranties and/or representations in respect to the Services, including but not limited to the quality, availability and/or performance of the Services. We are not liable for any claims, loss or damages made by You in this respect.
Limits Of Liability and Disclaimer
The Wash Laundry Services’ liability shall be limited to general money damages in a maximum amount not to exceed the charges for incurred by customer during the term in which the damages are alleged to have occurred. This liability shall be the extent of The Wash Laundry Services’ liability regardless of the form in which any legal or equitable action may be brought and the foregoing shall constitute the customer’s exclusive remedy. The Wash Laundry Services disclaims all warranties, express or implied, with respect to The Wash Laundry Services Providers/Partners and the services rendered to the customer, including without limitation warranty of merchantability and warranty of fitness for a particular purpose. UNDER NO CIRCUMSTANCES SHALL The Wash Laundry Services OR The Wash Laundry Services’ PROVIDERS/PARTNERS BE LIABLE TO CUSTOMERS OR ANY THIRD PARTY FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES (EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING FROM THIS AGREEMENT, PROVISION OF SERVICES HEREUNDER OR ACTS OR OMMISSIONS OF The Wash Laundry Services’ PROVIDERS/PARTNERS SUCH AS, BUT NOT LIMITED TO,LOSS OF USE; LOSS OF REVENUE, ANTICIPATED PROFITS OR LOST BUSINESS; COSTS OF DELAY; PERSONAL OR PROPERTY DAMAGE, OR LIABILITIES TO THIRD PARTIES ARISING FROM ANY SOURCE.
Confidentiality and Disclaimer
The Wash Laundry Services takes privacy and personal information seriously. We use customer information to provide services, to process payment, facilitate billing, and for any other purpose reasonably necessary to provide services under this Agreement. Additionally, personal information may be disclosed when required by law necessary to enforce this Agreement or necessary to protect the rights, interests, property of safety of The Wash Laundry Services. We may send you notices about specials and new products.
